  1. This Promotion and Draw is brought to you by BIC Australia pty. Ltd. & TLC Marketing Worldwide Asia Pacific Pty Ltd.
  2. Under this Promotion, on purchase of BIC Utility Lighters (BIC Lighters) from Coles stores (including Coles Express) or Coles online during the promotional period. , the purchaser will be entitled to Weber vouchers worth $50 to be used on the Weber website towards the purchase of Weber BBQ’s (“Offer”). You will also be eligible to be part of lucky Draw.
  3. The Offer is applicable on BIC Utility Lighters (see product description) available at Coles only (including Coles Express) , either in store or online.
  4. The Offer is not applicable on any other range offered by the company and is applicable for the period mentioned in the terms and conditions below or till stock lasts, whichever is earlier.
  5. The only persons who may participate in the Offer cum Draw are Australian residents over the age of 18, who are not employees of the Promoter or TLC or the immediate family of such employees. “Immediate family” means spouse, parent, child or sibling, whether or not they live in the same household as the employee (“Eligible Entrant”).
TERMS & CONDITIONS OF PROMOTION
The following terms and conditions (Terms and Conditions) apply for your prizes on offer (the Promotion). By submitting an entry into the Promotion, the entrant warrants that they have read, understood and accepted these Terms and Conditions.
  1. Definitions: For the sake of clarity and interpretation:
    1. “Claim Period” shall mean the period during which the customer can Claim the Voucher;
    2. “Draw” shall mean computerised draw system or selection on 16th March 2022 at 3:00 PM AEDT;
    3. “Entrant” shall mean the customer who purchases BIC Lighters from Coles (including Coles Express) either in store or online and uploaded the receipt;
    4. “Offer” shall mean a right to claim Weber Store Gift card vouchers worth $50 to be used on the Weber website towards the purchase of a Weber BBQ on purchase of BIC Lighter from Coles within Claim Period
    5. “Promotion” shall mean Offer run by the Promoter and TLC on BIC Lighters within the Claim Period
    6. “Promoter” shall mean BIC AUSTRALIA PTY. LTD. ABN 88 004 304 830 whose premises are at, Level 4, 574 St Kilda Road, Melbourne, Victoria 3004, Australia
    7. “Purchase Period” shall mean purchase of Participant Products made between 12.01am AEDT on 5th January 2022 and 11.59pm AEDT on 8th February 2022.
    8. “Qualifying Purchases” shall mean a purchase of the participating products listed below within the promotional period from Coles stores (including Coles Express) or Coles online.
    9. “Prize Winner” shall mean winner as will be determined in lucky draw to be eligible for Weber BBQ valued at $ 500;
    10. “Reserve Winner” shall mean winners that have been drawn after the Prize winner. The Reserve Winners will only be used if the Prize Winner is unable to claim the prize.
    11. “TLC” shall mean TLC Marketing Worldwide Asia Pacific Pty Ltd, ABN 75 622 802 180, Ground Floor, 320 Pitt Street, Sydney NSW, 2000, Australia, who will administer and manage the Promotion and Lucky Draw.
    12. Voucher shall mean voucher of Weber Store Gift Card vouchers worth $50 on purchase of BIC Utility Lighters.
  2. This Promotion is conducted by BIC AUSTRALIA PTY. LTD (Promoter) and administered by TLC Marketing Worldwide Asia Pacific Pty Ltd(“TLC”). All correspondence regarding this Promotion should be directed to TLC address.
  3. The Promotion commences at 12.01 am 5th January 2022 and concludes at 11.59 pm 8th February 2022 (Promotional Period). Entries are deemed received at the time of receipt by the Promoter in its promotional database and not at the time of transmission of online registration by the entrant.

    • The Claim Period opens between 12.01am AEDT on 5th January 2022 and 11.59pm AEDT on 8th March 2022 (“Claim Period”).
    • Customers must upload their receipt within 30 days of purchase or before 8th March 2022, whichever is earlier.
    • The Weber BBQ Prize Draw will take place on 16th March 2022 at 3pm.
    • All reward access codes will be valid for 2 (two) months upon issuance or up to 8th May 2022, whichever is earlier.
  5. To enter customers must purchase, in one transaction one (1) participating promotional product highlighted in Coles (including Coles Express). The customer needs to retain the receipt as proof of purchase to register online. Participating products in the Promotion mean BIC Utility Lighters including:

  6. The customer must register at www.bicbuyandwin.com.au, where they will need to upload their Proof of Purchase (Receipt) and their contact details. Prizes are an instant win and will be allocated when the registration is verified as valid on the promotional website. A confirmation email with details how to redeem the reward voucher will be sent to them within three (3) business days.
  7. Multiple claims are permitted. Each claim must be a qualifying purchase and be accompanied by a unique Coles receipt and only one claim per person per day will be accepted. Offer valid while stocks last.
  8. Entry will be considered only if the fields within the advertised promotional website are completed in full with a valid proof of purchase and the entry is received prior to the conclusion date as detailed.
  9. Each rewards voucher is a $50 Weber voucher and can be used against the purchase of a Weber BBQ. A total of up to 199,995 vouchers can be claimed during the promotional period against equal no. of products. Only one $50 voucher may be redeemed against each Weber BBQ purchase. The rewards vouchers remain subject to availability.
  10. The Promoter and TLC reserves the right, at any time, to verify the validity of entries and entrants (including any entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions, who tampers with the entry process or who submits an entry that the Promoter and TLC, in its sole discretion, deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the Promotion.
  11. Errors and omissions may be accepted at the Promoter and TLC discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable, or illegible entries will be deemed invalid.
  12. The Draw is a game of chance and skill plays no part in determining the winner. Each valid entry will be entered into a pool and drawn from random via an approved electronic regulated system. A person may enter the Promotion as many times as they like, with multiple receipt numbers and can be eligible to win multiple times during the Promotional Period, provided they meet the requirements for entry in respect of each entry made.
  13. Entrants who make a Qualified Claim for each Instant Win Prize will also automatically receive one (1) entry to the Weber BBQ Prize Draw (“Weber BBQ Prize Draw Valid Entrants”), as outlined in Weber BBQ Prize Draw below.
  14. The total combined promotion prize pool and reward voucher value is $10,002,250 and will be made up of the following:

    Every person who enters the promotion and made a valid claim will also receive an entry to the prize draw for a chance to win one (1) of five (5) Weber Family Q3200 LP Titanium BBQ’s to the total value of $3,745.

    All rewards are subject to Promotional Partner Terms and Conditions (Outlined in Schedule 1).

  15. A rewards voucher will be allocated once a valid claim is verified, the reward is revealed and customers simply follow the prompts to redeem the reward, a confirmation email which details how to use the voucher will then be sent to the customers via email: contact@bicbuyandwin.com.au. The email will request you to nominate your choice of Weber BBQ purchase, and request payment for the remaining balance of the chosen Weber BBQ less the $50 Weber voucher reward, and delivery details.
  16. The Reward is subject to availability. If the Reward is unavailable, for whatever reason, TLC reserves the right to substitute the Reward for a reward of equal value and/or specification subject to any written directions for a regulatory authority.
  17. The Promoter or TLC reserve the right to vary the terms of the Promotion at any time and to withdraw the Promotion without notice.
  18. Prizes, or any unused portion of a prize, are not transferable or exchangeable and the Promotion Winners are advised that tax implications may arise from their Promotion winnings and they should seek independent financial advice prior to the acceptance of a prize.
  19. Other than any liability that cannot be excluded by law (including the Australian Consumer Law), the entrant releases the Promoter from, and the Promoter and TLC is not liable for, any loss or damage that is suffered (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained, arising in any way out of participation in the Promotion, including but not limited to, loss or damage arising as a result of the following;
    1. receiving, accepting or using the Prize;
    2. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    3. any theft, unauthorised access or third party interference;
    4. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or TLC) due to any reason beyond the reasonable control of the Promoter; and
    5. any tax liability incurred by a Prize winner or Eligible Entrant
  20. By entering this Promotion, each entrant acknowledges and agrees that:
    1. they will at all times conduct themselves in a proper manner, having consideration for other Eligible Entrants, the Promoter and any other person; and
    2. they indemnify the Promoter or TLC for any damage, loss, cost or expense caused to any third party, property, any person or otherwise (Relevant Cost) as a result of their actions or omissions during and related to the conduct of the Promotion and must promptly pay any Relevant Costs to the Promoter or TLC (or any other relevant person) on demand.
  21. As a condition of participation in the Promotion, each Eligible Entrant may be required to sign legal documentation as and in the form required by the Promoter or TLC in their absolute discretion, including but not limited to a legal release and indemnity form.
  22. Entries will be deemed to be accepted at the time of receipt by the Promoter and not at the time of transmission by the entrant. The Promoter or TLC is not liable for any delays in the processing of information or for late, lost or miscalculated entries. If for any reason the Promotion is not capable of running as planned, including but not limited to reasons due to computer viruses, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of the Promoter or TLC which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter and TLC may in its sole discretion cancel, terminate, modify or suspend the Promotion, subject to any written directions under State or Territory legislation.
  23. The Promoter and TLC collects personal information about entrants (whether Eligible Entrants or otherwise) to include entrant s in the Promotion and where appropriate, award Prizes. If any information requested by the Promoter or TLC is not provided, the Entrant may not participate in the Promotion. By entering the Promotion, each entrant agrees that the Promoter or TLC may disclose an entrants’ personal information to State and Territory lottery/gaming departments, and that the winner’s name and locality will be published as required under the relevant lottery/gaming legislation. A request to access, update or correct any personal information should be directed to the Promoter and TLC in writing at its premises.
  24. If an Eligible Entrant is unable to or refuses or fails to take part in any element of this Promotion, or a winning entry is deemed not to comply with these Terms and Conditions, the Promoter and TLC reserves the right to discard that Eligible Entrant’s entry and proceed as if that entrant had not entered the Promotion (whether they are an Eligible Entrant or otherwise).
  25. The entrant consents to the Promoter and TLC using (or permitting authorised third parties to use) the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome), the Promoter or TLC and or products/services supplied by the Promoter or TLC.
  26. These Terms and Conditions are subject, where appropriate, to State and Territory legislation. If any term infringes any law applicable to it and is as a consequence illegal, invalid or unenforceable then:
    1. Where the offending term can be read down so as to give it a valid and enforceable operation of a partial nature it must be read down to the extent necessary to achieve that result; and
    2. In any other case, the offending provision must be severed from these Terms and Conditions in which even the remaining terms operate as if the severed term had not been included.
WEBER BBQ PRIZE DRAW TERMS & CONDITIONS (to be read in conjunction with the general terms and conditions)
  1. The Weber Family Q3200 LP Titanium BBQ’s of $749 each ($3,745 in total) will be won by 5 (five) winners.
  2. The winner will be notified in writing within three (3) business days of the draw via the email address provided by the winner; and by the phone number provided by the winner. The winner will be notified and their details published on the terms page at www.bicbuyandwin.com.au on 31st March 2022
  3. Prize must be claimed by 30th June 2022 at 4:00 PM AEST. Unclaimed prizes will be awarded to the 1st reserve winner, and so on. The reserve winner of the unclaimed prize will be notified via email and phone (and their details published) at www.bicbuyandwin.com.au on 31st July 2022.
  4. The prize is not transferable, substitutable or exchangeable for cash or any other product (including any unused portion).
  5. 16th March 2022 at 3:00 PM AEDT - computerised draw system or selection: The winner will be determined by a random draw. The draw for the prize will take place on 16th March 2022 at 3:00 PM AEDT at TLC Marketing Worldwide Asia Pacific Pty Ltd, ABN 75 622 802 180, Ground Floor, 320 Pitt St, Sydney 2000 Australia by computerised draw system or selection. The Promoter or TLC warrants that the computerised draw system used to draw the prize has been appraised by a suitably qualified person into the operation and integrity of the computerised draw system. The winning entrant does not need to be present at the draw to claim a prize.
  6. The first eligible entry drawn will win one (1) of five (5) Weber Family Q3200 LP Titanium BBQ’s which worth a value of $749, and so on.
  7. Reserve winners will be drawn and will only be used if winner is deemed invalid. Reserve winners will be drawn and record them (in order) in case an ineligible entrant is drawn or if any entrant drawn is unable to accept or declines to participate in a prize within fourteen (14) days of being successfully notified that they are a winner (if applicable), then the prize will be awarded to the reserve winner.
    1. If any particular draw is scheduled on a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter or TLC will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance. Skill plays no part in determining the winners.
  8. It would be mandatory for the winner to show a valid proof of purchase to claim the prize.
  9. If a Prize Winner chooses not to take their prize or is unable to be contacted, or, upon being contacted and notified of their prize, rejects the prize for whatever reason, or does not claim their prize in accordance with the notification or other instructions issued by the Promoter within 7 days of being notified by the Promoter, their Prize will be forfeited and Reserve winner will be notified
  10. For the purposes of public statements and advertisements, TLC or the Promoter may only publish the winner’s surname, initial and State. TLC and the Promoter’s privacy policies contain information about how the entrant may access, update and seek correction of the personal information TLC or the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with.
  11. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  12. The winners of lucky draw may be required to participate in a photo taking session. By submitting your entry in the promotion, you consent to your pictures being used in media for purposes of promoting sale of BIC® products.

Schedule 1 – Rewards Voucher Terms and Conditions
  • Each $50 Weber reward voucher is to be used towards the purchase of a Weber BBQ.
  • Each $50 Weber reward voucher will be administered by the Buy & Win with BIC customer service team. You will be sent an email requesting your choice of Weber BBQ, payment details for the remaining balance after the $50 Weber voucher reward has been deducted and delivery details. The team will then process your order and send order confirmation to your nominated email address.
  • Each $50 Weber voucher reward is valid for 72 hours only, you must respond to the email with your choice of Weber BBQ and delivery details within this timeframe. The $50 Weber voucher reward has been awarded with the understanding that it will not be extended beyond this expiry date.
  • Each $50 Weber voucher reward is single use only and only one $50 Weber voucher reward can be used for each Weber BBQ purchase.
  • Each $50 Weber voucher reward must be used in full in one transaction and is only valid for a maximum of one per transaction. Any remaining value will be forfeited.
  • Each $50 Weber voucher reward is not valid for use in conjunction with any other voucher.
